Daniel Martinez, a 17-year-old Latino youth, was shot at the intersection of Nordoff Street and Orion Avenue in North Hills and died at 1:23 p.m. Jan. 31.
Martinez was shot on his way home from school in a drive-by in the 15500 block of Nordhoff Street in the San Fernando Valley at 12:45 p.m. Jan. 31. The Einstein continuation student was in the company of classmates and Monroe High School students. Police are looking for suspects in a black two-door car with faded paint. Call Det. Update: LAPD Mission detectives said two Latino men were arrested. Police said they drove by in a car, exchanged gang insults or challenges with Daniel, then shot him from the car.

At least one of the suspects in custody is innocent of this homicide, but the authorities believe he should still be charge just because he is an active gang member. Is this what the law states??

John Doe, how do you know he is innocent? Was he released or found innocent at trial?
Having active members of a gang be held responsible for the activities of their "homies" is a great idea. With one incident, we can clear out dozens of gangsters from society and never have to worry about them again.
Its just a shame the DA's never make use of the RICO statutes to do it.
Maybe the Times reporters can interview the California and Federal DA's on why they dont use RICO against the gangs?

Gangs have been here for a century or more, back in the days white people were fascinated by white gangs and now a days you have the dominant stronger more violent gangs and white peopl are all of a sudden against gangs? Lol, what a bunch of BS. still out n about.

You are so inaccurate about the historical basis of gangs, you need a CJ101 class.

As a matter of fact syscom3 I do know one of the suspects in this awful murder, and I was with him at the time and day of the murder. And we where in Palos Verde, CA, working in construction. My boss testified and that didn't help. The suspect I know is Latino and the boss is White, if this helps you rationalize this a fair trial. By the way, I also knew Daniel Martinez personally, we were classmates not long ago. So I lost two friends, both from different backgrounds, both to injustice.
Drug addicts get sent to jail, not all but I guess if I used your way of processing things shouldn't they all be locked up?? I think I'll have to contact some reporters don't you?
Also curious about something, was Daniel family to you? Seems weird you comment right after one is left?? Weird!!!!

The fact of the matter here is that three lives were ruined do to this one horrible crime. Where are the parents? Why do we allow our young children to be brainwashed by these animals? If we would give our children the time that these sick individuals do, the world would be a much better place. Let's teach our children about integrity and get them off the streets. We're slowly losing a grip on our humanity. As a Latino father and member of this society and great country, we need to show our children a better way.
